Terms of Service

These Terms of Service govern your use of poparooz.com and your purchases from Poparooz.
Poparooz is a brand of Atlas Commerce LLC. In these Terms, “Poparooz,” “we,” “us,” and “our” refer to Atlas Commerce LLC operating under the Poparooz brand.
By accessing the website, placing an order, submitting content, or using our services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old or have reached the legal age of majority in your jurisdiction to place an order.
If you place an order on behalf of another person or organization, you represent that you are authorized to bind that person or organization.
2. Store Use
You may use the website only for lawful personal or legitimate business purposes consistent with these Terms.
You must not:
- Use the store for fraud or unlawful activity;
- Attempt unauthorized access to the website or another customer’s information;
- Interfere with store security or operation;
- Introduce malware or harmful code;
- Scrape, copy, or extract store content through automated means without permission;
- Submit unlawful, infringing, hateful, sexually explicit, deceptive, or abusive content; or
- Misuse promotions, reviews, refunds, payment disputes, or customer-service procedures.
3. Product Information
We make reasonable efforts to display product descriptions, dimensions, quantities, colors, and photographs accurately.
Actual colors may vary because of screens, lighting, photography, materials, and manufacturing batches.
Bead quantities described as approximate may be estimated using net weight. Minor variation is possible.
Dimensions and completed results may also vary slightly because of materials, assembly, heating methods, and manual production.
4. Prices and Payment
Prices are displayed in United States dollars unless otherwise stated.
Applicable sales tax and shipping charges are shown during checkout.
We may correct obvious pricing, description, promotional, or system errors. If an order was placed using an obvious error, we may contact the customer to confirm the corrected terms or cancel the affected item and issue a refund.
Payment must be authorized before fulfillment.
5. Order Acceptance
An order confirmation means that we have received the order. It does not necessarily mean that the order has been finally accepted for production or fulfillment.
We may limit, decline, or cancel an order for legitimate reasons, including:
- Suspected fraud or unauthorized payment;
- Incorrect pricing;
- Inventory unavailability;
- Shipping restrictions;
- Prohibited customer content;
- Repeated policy abuse;
- Technical errors; or
- Inability to complete a custom request.
When we cancel a paid order, we will refund the cancelled portion to the original payment method.
6. Personalized Orders and Proofs
Customers must provide complete and accurate customization instructions.
One reasonable proof revision is included before production begins unless the product page states otherwise.
The customer is responsible for carefully reviewing:
- Names;
- Images;
- Colors;
- Dimensions;
- Orientation;
- Spelling;
- Layout; and
- Other customization details.
Approval authorizes us to begin production using the approved proof.
If the customer does not respond within two business days, we may send a reminder and subsequently proceed using the most recent proof and instructions.
Minor differences may occur between a digital proof and a physical product because of materials, bead availability, screen display, manufacturing variation, or the physical nature of pixel-art production.
7. Customer Content
You retain ownership of the image or other content you submit.
By submitting content, you grant Poparooz a limited, nonexclusive, temporary right to access, reproduce, resize, crop, convert, modify, and transmit the content only as reasonably necessary to:
- Review the request;
- Prepare a proof;
- Produce the product;
- Fulfill the order; and
- Resolve related customer-service issues.
This permission does not transfer ownership of your content to Poparooz.
You represent that:
- You own the content or have permission to use it;
- The content does not violate another person’s privacy, publicity, copyright, trademark, or other rights;
- You are authorized to submit images of minors or other individuals shown; and
- The requested use is lawful.
We may refuse images or designs involving:
- Unauthorized third-party photographs;
- Public figures or celebrities;
- Copyrighted characters or artwork without authorization;
- Third-party trademarks without authorization;
- Sexual or exploitative content;
- Hate-related content;
- Illegal content; or
- Content reasonably considered unsafe or inappropriate.
We will not use submitted photographs or completed custom products for advertising or public promotion without separate, clear customer permission.
8. Pattern Generator and Digital Output
When available, the Poparooz pattern generator may be offered as a free tool.
Unless we provide separate written permission, generator output is licensed for personal, noncommercial use only.
You may not:
- Sell or redistribute generated pattern files;
- Offer them as a competing pattern service;
- Use automated tools to extract or reproduce the generator;
- Use the output for mass commercial production; or
- Remove ownership, attribution, security, or technical notices.
Generated patterns, color matches, bead counts, dimensions, and material estimates are computational estimates. Customers should review the result before purchasing materials or beginning production.
We do not guarantee that every generated result will perfectly reproduce the source image or match every physical bead batch.
9. Intellectual Property
The website, Poparooz branding, text, product photographs, layouts, software, generator, graphics, original patterns, and other store materials are owned by or licensed to Atlas Commerce LLC and are protected by applicable intellectual-property laws.
No rights are granted except the limited right to use the store and purchased materials in accordance with these Terms.
10. Product Safety
Poparooz products may contain small parts and are generally recommended for ages 16 and older.
They are not intended for unsupervised use by young children.
Heating equipment, irons, heat presses, and hot materials can cause burns, fire, or property damage. Heating must be performed by a responsible adult or under direct adult supervision and in accordance with the equipment manufacturer’s instructions.
Customers are responsible for selecting a safe workspace and using suitable protective materials.
11. Shipping, Returns, and Cancellations
Shipping, return, refund, and cancellation conditions are governed by our posted Shipping Policy and Refund, Return and Cancellation Policy.
Those policies form part of these Terms.
12. Promotions
Promotions, discounts, gifts, and coupon codes may be subject to separate conditions.
We may reject or cancel a promotion affected by:
- A system error;
- Fraud;
- Unauthorized distribution;
- Duplicate or prohibited use;
- Incorrect pricing;
- Inventory limitations; or
- Conduct inconsistent with the stated promotion.
Where an affected paid order is cancelled, the cancelled amount will be refunded.
13. Wholesale Orders
Wholesale or bulk orders may be accepted under separate written terms.
Retail discounts, standard return rights, production times, and shipping terms may not apply to a separately negotiated wholesale order.
14. Third-Party Services
The store may rely on or link to services provided by Shopify, payment providers, review applications, carriers, messaging services, or other third parties.
Third-party services are governed by their own terms and privacy practices. We are not responsible for a third party’s independent acts outside our reasonable control.
15. Disclaimer
To the maximum extent permitted by law, the website and free digital tools are provided on an “as available” basis.
We do not guarantee uninterrupted access, error-free output, perfect color reproduction, or suitability for every individual project.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.
16. Limitation of Liability
To the maximum extent permitted by law, Atlas Commerce LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, a free digital tool, or misuse of a product.
For a claim relating to a purchased product, our aggregate liability will not exceed the amount paid for the product giving rise to the claim, except where applicable law does not permit that limitation.
These limitations do not apply to liability that cannot legally be limited or excluded.
17. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
Mandatory consumer rights available under applicable law remain unaffected.
No mandatory arbitration or class-action waiver is created by these Terms.
18. Severability
If a provision is found unenforceable, the remaining provisions will remain effective to the maximum extent permitted by law.
19. Changes
We may update these Terms to reflect changes to our services, applications, products, or legal obligations.
The current version will be posted with its effective date.
